HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No5294 OF 2015 ORDER:

In this petition filed under Section Cr.P.C, petitioner/Accused seek to quash the proceedings in PRC.No.26 of 2011 on the file of II Additional Judicial Magistrate of First Class, Nellore, registered for the offences under Sections 452, 354, 427, 506, 323 r/w 34 IPC.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 06.07.2018 of SubInspector of Police, Nellore III Town Police Station, Nellore District and submitted that after filing of charge sheet, S.C.No.278 of 2013 was registered and the same was ended in acquittal vide judgment dated 07.03.2018 and therefore, the petition which is filed to quash the proceedings in PRC.No.26 of 2011 has become infructuous and hence the same may be dismissed. 3.

In view of the above submission of learned Assistant Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
