THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18749 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the respondents in permitting the fourth respondent to shift the school without maintaining the required distance from school to school and without following the norms as per the A.P. Private Institutions Rules and contrary to the Education act, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for Education. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not adjudicating the case on merits, there is no necessity to issue notice to respondent No.5.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts her prayer seeking a direction to the authorities to dispose of the representation submitted by the petitioner on 09.11.2015, at the earliest. Learned Government Pleader states no-objection for the same, provided the said representation is still pending consideration.

Having regard to the above, without going into the merits of the case, the Writ Petition is disposed of directing the respondentauthorities to deal with the representation submitted by the petitioner on 09.11.2015, if the same is still pending consideration, and pass necessary orders thereon, in accordance with law, as

early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
