THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.16270 of 2016 ORDER:

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, the petitioners pray that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents in insisting the petitioners to vacate from the marked portion of their landed properties covered by Survey Numbers 109/2B, 142/B, 143/A1, 141/B, 148/C, 155/C, 156/B, 149/B, 108/B, 143, 144, 145/A/A, 146, 147, 156/A, 142/C, 150/A, Ac.

148/B and 141/C situated at Vemsoor and Yerragunta Revenue Villages in Vemsoor Mandal of Khammam District as illegal, irregular, irrational, without any authority of law and offends articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to undertake any feeder channel excavation work in the aforesaid lands of petitioners, otherwise than any known procedure established by law and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." The Executive Engineer, Irrigation Division, Khammam, furnished written instructions dated 11.05.2016 to the office of the learned Government Pleader for Irrigation, wherein he stated that excavations would be taken up in the petitioners' land only after acquiring them duly following the process of law.

The afore-stated stand of the irrigation authorities is taken on record.

In the light thereof, no adjudication is warranted on merits in this writ petition, which is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
