THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18944 OF 2017 ORDER:

This Writ Petition is filed by the petitioner with the prayer which reads as follows:- "to issue a Writ/Order/Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in trying to erect sub-station in Sy.No.6 to an extent of Ac.10-14gts of the petitioner situated at Jilledu(V), Chowdargudem Mandal (formerly Kondurg), Ranga Reddy District as illegal, arbitrary, without jurisdiction and in violation of provisions of Act, 2013 besides violation of Art.14 & 300-A of the Constitution of India and consequently direct the respondents not to erect sub-station in Sy.No.6 to an extent of 10-14 gts situated in Jilledu (V), Chowdargudem Mandal(formerly Kondurg), Ranga Reddy District without following the procedure enunciated under law."

Heard learned counsel for the petitioner and learned Government Pleader for Energy for the 1st respondent and recorded the offer of Sri R.Vindod Reddy, learned standing counsel representing the respondents 2 to 5, to file vakalat and perused the prayer in the writ petition with supporting affidavit and other material on record.

Against the apprehension of the petitioner of respondents are trying to take law into their hands to erect an

electrical substation without initiation of the proceedings for acquisition, the submission of the learned standing counsel, on instructions, and the learned Government Pleader is that there is no such proposal.

Recording the said submission, this writ petition is disposed of, with a direction to the respondents not to interfere with the petitioner's rights except through due process of law.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
