THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.34659 OF 2011 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 1st respondent in not absorbing/ regularizing the services of the Petitioner in TTDs in terms of the order dt.15.10.2001 in W.P. No. 21410 of 2001, confirmed by the Hon'ble Supreme Court of India, as arbitrary, discriminatory and illegal and consequently direct the 1st respondent to absorb/regularize the services of the Petitioner in TTD College Hostels, as has been done in respect of all other similarly situated employees, in the light of the clarification issued in GO Ms. No. 2500 Rev. (Endts. III) Dept., dt. 20.11.2007, with a further direction of the 1st Respondent to pay salary to the petitioner for the period from November, 2001 to till 11.2.2011 and with all other consequential benefits, monetary or otherwise."

2. When the matter is called, a memo bearing No.29125/Endts.III/A2/2011, dated 11.09.2015, has been placed on record by Sri A.K.Jaya Prakash Rao, learned Standing Counsel for the T.T.D. and the said memo reads as under:

"In the circumstances reported by the Executive Officer, Tirumala Tirupati Devasthanams, Tirupati, in the reference 1st and 5th read above and keeping in view the judgments of the High Court and Supreme Court, in the reference 2nd and 4th read above, the Government after careful examination of the matter hereby accord permission to the E.O., TTD., to create one post of cleaner at SGS Arts College Hostel, so as to regularize the Services of Sri B.Chandra Babu from the date of issue of Court Orders.

2. This permission shall be treated as purely limited

to the instant case only and will not be a precedent for any other case. It is only permitted only in pursuance of the orders of Supreme Court of India, dated 06.01.2011.

3. The Executive Officer, Tirumala Tirupati Devasthanams, Tirupati, shall take further necessary action in the matter, accordingly."

3. In view of the said memo and the contents therein, this writ petition stands disposed of, by placing on record the contents of the said memo bearing No.29125/Endts.III/A2/2011, dated 11.09.2015.
