BHASKAR REDDY Advocate for the Petitioner, The Public Prosecutor (AP) for the Respondent and the Court made the following.

This Criminal Petition is filed by the petitioners under section 438 Cr.P.C., seeking grant of anticipatory bail to the petitioners, who are A2 and A3 in Crime No. 287 of 2017 of Vempalli Police Station, Kadapa district, registered for the offences punishable under section 304-B, 498-A read with section 34 of I.P.C.

2. Heard the learned counsel for the petitioners/A2 and A3 and the learned Additional Public Prosecutor appearing on behalf of the respondent/State.

3. Perused the report. The second petitioner herein took the deceased to her house and later all of them started harassing. Due to harassment and due to the directions of the accused to take away the defacto-complainant to their house, she was brought to the house of the defacto complainant on 04/09/2017 and this incident occurred on 03/12/2017 at 08:30 a.m. at Brundavan colony, Vempalli town and was reported in the Police Station on the same day at 04:00 p.m.

4. Hence, considering the above facts and circumstances, this Court opines that it is a fit case to grant anticipatory bail to the petitioners.

5. In the result, this Criminal Petition is allowed and the petitioners, who are A-2 and A-3 are directed to be enlarged on bail in the event of their arrest in Crime No. 287 of 2017 of Vempalli Police Station, Kadapa district, on each of them executing a personal bond for Rs. 20,000/- [Rs. Twenty Thousand only] with two sureties for the like sum each to the satisfaction of Station House Officer, Vempalli Police Station, Kadapa district.

5. Further, on such release, the petitioners/A2 and A3 shall abide by the conditions enunciated under Section 438 (2) Cr.P.C., which are as hereunder :

i) The petitioners shall make himself available for interrogation by a Police Officer as and when required ; ii) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer ; and iii) The petitioners shall not leave India without the previous permission of the Court.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
