THE HON'BLE SRI JUSTICE T. VINOD KUMAR CONTEMPT CASE Nos.1886, 1888, 1890, 1902, 1903 OF 2022 COMMON ORDER:

These Contempt Cases are filed alleging disobedience of the interim order passed by this Court in W.P. No.37513 of 2022 dated 28.09.2022 and the interference of the respondents with the conduct of the business activities of the petitioners in carrying on the business dealing in jaggery.

When these Contempt Cases are taken up for hearing, learned Government Pleader for Prohibition & Excise has placed before this Court the proceedings Cr.

No.736/2012/ EOE/C3/H2 dated 23.01.2023 of the Director, Prohibition & Excise, whereby the said authority has issued instructions to all the authorities concerned to follow the Gur (Regulation of Use) Order, 1968 and would submit that the authorities are scrupulously following the said instructions issued by the Director of Prohibition & Excise. It is also submitted by the learned Government Pleader that only when infraction in complying with Regulation by the traders is found necessary action in accordance with law is being initiated. 2.

The above said statement of the learned Government Pleader is taken on record.

Having regard to the submissions made and considering the circular dated 23.01.2023 issued by the Director of Prohibition & Excise in relation to the instructions to be followed, this Court is of the view that no further orders in the Contempt Cases are necessary. However, liberty is given to the petitioner in the event the respondent authorities seek to deviate from the said instructions issued by the Director of Prohibition & Excise under his proceedings dated 23.01.2023. 4.

Subject to the above observation, all the Contempt Cases are closed. No costs.

Miscellaneous petitions, if any, pending in the Contempt Case, shall stand closed.
