HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28561 OF 2018 ORDER:

The present writ petition came to be filed seeking issuance of Writ of Mandamus to declare the action of the 3rd respondent in not conducting the survey pursuant to the applications TFS011800192598 dated 18.05.2018 and FS011800192598 of the petitioner, as arbitrary and illegal.

The learned counsel for the petitioner submits that the writ petition may be disposed of directing the 3rd respondent-Tahsildar to conduct the survey in respect of land admeasuring Ac.3.38 cents situated at Sy.Nos.158 and 159 of Maachapuram Village, Devanakonda Mandal, Kurnool District, basing on the applications of the petitioner dated 18.05.2018 submitted by him through TFS011800192598 dated 18.05.2018 and FS011800192598 at the earliest. The same is not disputed by the learned Government Pleader for Revenue. Having regard to the facts and circumstances of the case, without going into the merits of the matter, the writ petition is disposed of directing the 3rd respondent-Tahsildar, to conduct the survey of the land admeasuring Ac.3.38 cents situated at Sy.Nos.

158 and 159 of Maachapuram Village, Devanakonda Mandal, Kurnool District, basing on the applications of the petitioner dated 18.05.2018 submitted by him through TFS011800192598 dated 18.05.2018 and FS011800192598, in accordance with law as early as possible preferably, within a period of eight weeks from the date of receipt of copy of the order after giving notice to all concerned and also taking into consideration their objections.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
