THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.2078 OF 2015 ORDER:

This Contempt Case was instituted alleging willful disobedience to the order dated 17.6.2015 passed in WPMP No.22395 of 2015 in W.P.No.17288 of 2015.

By the said order, this Court took note of the revenue records which demonstrated the Writ Petitioner's possession over the subject land and directed the authorities not to interfere with such possession except in accordance with the due procedure laid down by law. Alleging that the third respondent Tahsildar of Aswaraopet Mandal started harassing him by sending subordinates to his house, the writ petitioner filed this Contempt Case.

The third respondent Tahsildar filed a counter affidavit stating that though a pattadar pass book and title deed were issued to the petitioner under the provisions of the the Telangana Rights in Land and Pattadar Passbooks Act, 1971, in relation to the land admeasuring Ac.0-38 guntas in Sy.No.496 of Aswaraopet Village, he was not in actual possession of the land. He further stated that he never called upon the petitioner to vacate the said land or send any one to his house. The Tahsildar also stated that the petitioner filed a suit in O.S.No.200 of 1989 against one Chinnamesetty Venkateswar Rao seeking a perpetual injunction, but the trial Court dismissed the said suit holding that the petitioner had miserably failed to prove his possession and enjoyment over the suit property, which was the subject matter of the pattadar pass book and title deed. He further stated that the appeal sought to be preferred by the petitioner

against the said judgment was dismissed at the threshold on the ground of delay.

In the light of the aforestated facts, this Court finds no grounds to exercise contempt jurisdiction. The Contempt Case is accordingly dismissed. No order as to costs.
