HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.28642 of 2015 ORDER:

Heard Sri Mummaneni Srinivasa Rao, learned counsel appearing for the petitioner, learned Government Pleader for Transport-R.1 and Sri N. Vasudeva Reddy, learned standing counsel for respondents 2 to 5.

2. The petitioner was appointed as Contract Conductor in the 5th respondent Depot in the year 1998. While so, he was absent for duty from 17.02.2009 to 02.03.2009 due to ill-health and when he reported to duty on 02.03.2009, the 5th respondent refused to take him into service and passed orders on the same day straight away terminating the petitioner from service. Thereafter, on the advise of the 5th respondent, he filed an appeal on 07.01.2015 before the 4th respondent, which was rejected on 05.02.2015. Then the petitioner filed a review petition before the 3rd respondent on 19.02.2015, which was also rejected on 03.03.2015. As against the said orders, he filed mercy petition before the 2nd respondent on 09.03.2015 to take him into service as a fresh contract conductor and the same is pending.

3. Under these circumstances, without going into the merits of the case, the 2nd respondent is directed to consider and dispose of the mercy petition dated 09.03.2015 filed by the petitioner and pass appropriate orders thereon, in accordance with the Rules, within a period of eight (8) weeks, from the date of receipt of a copy of this order.

4. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
