THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos. 9520 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners who is arrayed as Accused Nos.1 & 2 in Crime Nos. 116 of 2022 on the file of Station House Officer, Godavarikhani II Town Police Station, registered for the offence punishable under Sections 417, 420, 306 read with 511, 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioners/Accused Nos.1 & 2 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioners is that the petitioner No.1 took an amount of Rs.5,90,000/- from the victim namely Sri A. Srinivas who was examined as LW.7 during the course of investigation by the police. It is alleged that having taken the said amount of Rs.5,90,000/-, the said Sri A.Srinivas was provided with a job. However, Srinivas apprehended that he may be laid off the factory management for which reason, he consumed poison and immediately called the S.H.O to inform about his attempt to commit

suicide. He was treated in the hospital and statement was also recorded.

As seen from the remand case diary, 11 witnesses have already been examined including the victim. On an apprehension that the said A. Srinivas would be removed from his job, he consumed poison. However, he survived after receiving a treatment. In the said circumstances, the petitioners who are in jail since 11.10.2022 can be granted the relief of regular bail on conditions. 5.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos. 1 & 2 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.1 & 2 are directed to be released on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum, to the satisfaction of Principal Junior Civil Judge-Cum-Judicial Magistrate of First Class at Godavarikhani. ii) After release on bail, the petitioners/Accused No.1 shall appear before the concerned police station on every Monday for a

period of four weeks and the petitioner No.2 shall appear before the concerned Police Station on every Monday and Thursday for a period of six weeks.

iii) The petitioners/Accused Nos. 1 & 2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 15.11.2022 PKR
