Heard.

This criminal petition is filed under Section 482 of Cr.P.C to quash the proceedings in Crime No.213 of 2016 of Nidadavole Police Station, West Godavari District, for the offences punishable under Sections 419 and 420 IPC read with Sections 190 and 200 Cr.P.C.

The 2nd respondent filed private complaint before the Judicial Magistrate of First Class, Nidadavole making several allegations regarding deposit of amounts and attributing fraud etc. to the petitioner herein.

The main contention of the petitioner is that even if the allegations of the complaint are accepted, it took place within the jurisdictional limits of KPHB, Judicial Magistrate of First Class and hence, requested the Court to quash the proceedings.

This Court cannot quash the proceedings on the ground of lack of jurisdiction of the Judicial Magistrate of First Class. However, I deem it appropriate to direct the Judicial Magistrate of First Class, Nidadavole to decide the jurisdiction to proceed with the matter and pass appropriate orders within a period of one week from today.

With the above observation, the criminal petition is disposed of.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
