Order:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.1, in not granting provisional affiliation to respondent No.2 for the academic year 2009-2010, as illegal and arbitrary. At the hearing, Mr.A.Prabhakar Rao, learned Standing Counsel for Dr.NTR University of Health Sciences, on instructions, submitted that on the strength of the interim order granted by this Court,

respondent No.2 was granted affiliation for running B.Sc. (Nursing) course for the years 2009-2010 and also 2011-2012.

Mr.RN.Hemendranath Reddy, learned Counsel for the petitioners, submitted that in the light of the statement of the learned Standing Counsel, the Writ Petition may be disposed of as infructuous.

Having regard to the above submissions of the learned Counsel for the parties, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.No.35182 of 2010 is disposed of.
