THE HONOURABLE SMT 'USTICE P. SREE SUDHA SECOND APPEAL NO. 386 oF 2011 JUDGMENT:

Plaintiffs filed O.S.No.4B65 of 2004 on the file of XIX Junior Civil Judge, City Civil Court, Hyderabad, for recovery of possession. The trial Couft partly decreed the suit. The unsuccessful defendant preferred appeal vide A.S.No.138 of 2008 wherein the appellate Court had dismissed the appeal, against which the second appeal has been filed.

On 12.10.2023, learned counsel for the appellant stated that the matter would be infructuous and sought time for confirmation with the client. Today, there is no representation for the appellant and it seems that learned counsel for the appellant has no interest to pursue the litigation. No purpose would be served in continuing the second appeal.
