THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.15600 OF 2015 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the impugned proceedings in Rc.No.B3/9685/2013, dated 29.1.2014 issued by the 3rd respondent allowing the petitioner to continue as Senior Assistant instead of Manager, as illegal and arbitrary and consequently, to set aside the same with a direction to the 3rd respondent to continue the petitioner as Manager and treat the service of the petitioner as Manager since the date of his reinstatement i.e., 27.1.2014. 2.
Heard Sri K. Ananda Rao, learned Counsel for the petitioner and the learned Government Pleader for Endowments.

When this matter was taken up for admission and hearing, the learned Counsel for the petitioner informed that during the pendency of this writ petition, the services of the petitioner were terminated and challenging the said termination order, the petitioner filed W.P.No.15681 of 2016 and the same is pending.

In view of the submission made by the learned Counsel for the petitioner that the services of the petitioner were terminated, the relief sought in this writ petition cannot be considered as the cause in this writ petition does not survive. If the writ petitioner succeeds in W.P.No.15681 of 2016, he may seek the relief to continue him as Manager. 5.
Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. _____________________________ (ABHINAND KUMAR SHAVILI, J) 16th April, 2018 Nn
