HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.33771 of 2012 ORDER:

This writ petition is filed to declare the impugned notice dated 26-102012 issued by the 2nd respondent as illegal and arbitrary. The main grievance of the petitioners is that instead of conducting auction for a period of three months as per the impugned notice, they should be continued till 31-03-2013.

While ordering notice before admission, this Court granted the following interim order:

" Therefore, the petitioners are entitled to submit an appropriate representation to the respondents 2 and 3 for their continuance for the remaining part of the financial year 2012-2013 ending with 3103-2013, which shall be positively considered subject to the petitioners paying the arrears of rent up-to-date and continuing to pay the same by the due date for the remaining five months of the financial year. If any such representation is made, the order passed by the respondents thereon may be placed before this Court on the next date of hearing".

Now by afflux of time, the grievance of the petitioners in the writ petition stood redressed and the cause in the writ petition does not survive for adjudication and the same has become infructuous. Accordingly, the writ petition is dismissed as infructuous. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
