P Ankamma, Nellore Dist v. The State Of Ap And 5 Otehrs
HON'BLE SRI JUSTICE S.V.BHATT W.P.No.30057 of 2017 ORDER:
Heard Mr.Jalli Kanakaiah for petitioner and the Assistant Government Pleader (Revenue) for respondents. The petitioner prays for the following relief:- "....this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the orders passed by the 4th respondent vide proceedings No.D.Dis.(H) 3193/2016 dated 3.8.2017 in dismissing the appeal preferred by the petitioner to declare the lease rights granted in favour of the 6th respondent as illegal, arbitrary improper and violation of Principles of natural Justice and consequently set aside the same and allow the petitioner to enjoy the land allotted to the petitioner's mother to an extent of Ac.0.99 cents in Sy.No.398/5 and an extent of Ac.0.99 in Sy.No.398/6 of Nagasamudram Village Kaligiri Mandal SPSR Nellore district and to pass..."
Though the prayer is one of inaction in disposing of the appeal, it is stated by the counsel for petitioner that the petitioner is satisfied if a direction to dispose of the appeal filed against the order impugned in the writ petition is given. Having regard to the limited grievance, I am satisfied the writ petition can be disposed of by this order:
(a) the petitioner is given liberty to file memo before the 3rd respondent by enclosing a copy of this order and seek an early date for hearing of the appeal; and (a) on filing such memo, the 3rd respondent considers disposing of appeal filed by petitioner within three months thereafter.
The writ petition is, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J 26th June, 2018 Lrkm
