HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.13539 of 2015 ORDER:

This writ petition is filed questioning the action of the respondents 1 to 4 in not taking action against the illegal construction being undertaken by the respondent 5 and 6 in plot No.17 in Sy.No.8, Ferozguda, Kukatpally Municipality, GHMC, Circle-14, Hyderabad, pursuant to their complaints as illegal.

2. Heard the learned counsel for petitioners and learned standing counsel for GHMC and with their consent the writ petition is taken up for disposal at the stage of admission.

3. Petitioners claim to be owners and possessors of plot No.16 in Survey No.8, situated at Ferozguda, Kukatpally Municipality, GHMC Circle-14, Hyderabad and their sole grievance is that respondents 5 and 6, who are their neighbors, are undertaking construction of building against the sanctioned plan without leaving the setbacks. Petitioners stated to have submitted representations to respondent GHMC authorities dated 09.05.2014, 12.05.2014, 14,05.2014, 19.05.2014 and 23.05.2014 and allege that no action is taken thereon and the same are pending.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to respondent No.3 to expeditiously dispose of the complaints of the petitioners.

5. Having regard to the same, without expressing any opinion on merits of the matter, writ petition is disposed of directing the

respondent No.3 to consider the complaints of the petitioners dated 09.05.2014, 12.05.2014, 14,05.2014, 19.05.2014 and 23.05.2014 and after affording reasonable opportunity to respondents 5 and 6, pass appropriate orders as warranted under law within a period of four weeks from the date of receipt of a copy of this order and communicate the decision to the petitioners.
