HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 28330 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 06.08.2018 in O.A.No. 1566 of 2018 passed by the A.P. Administrative Tribunal, Hyderabad, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985, has been dismissed.
Heard the learned counsel for both the parties and perused the material placed on record.
The learned counsel for the petitioner has submitted that G.O.Ms.No. 257, dated 10.06.1999 is applicable and the case of the petitioner for promotion may be directed to be considered in terms thereof, however the same is disputed by the learned Government Pleader for Services (A.P.) appearing on behalf of the respondents.
It is to be taken note of that this Court, in similar writ petitions, has observed that the cases of the aggrieved parties are squarely covered by the terms of G.O.Ms.No. 257, dated 10.06.1999 for promotions. Inasmuch, the orders issued by the Government in G.O.Ms.No. 257, dated 10.06.1999 are also applicable to the petitioner's case, we hereby set aside the order dated 06.08.2018 in O.A.No. 1566 of 2018 passed by the
SKK,J & AKS,J WP_28330_2018 Tribunal, and consequently, the respondents are directed to consider the case of the petitioner for promotion strictly in terms of the orders issued by the Government in G.O.Ms.No. 257, dated 10.06.1999.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
