B.Sanjay Reddy S/O Late B.Vijayander Reddy v. Mr. Arjunan,
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH FRIDAY, THE TWENTIETH DAY OF MARCH TWO THOUSAND AND FIFTEEN
Present
Between:
B. Sanjay Reddy, Aged about 44 years, S/o. Late B. Vijayander Reddy, Occ: Business, R/o. 1-9-1, Bowenpally, Secunderabad-500 011 & 22 years .. Petitioners AND Mr. Arjunan, Branch Manager of Indian Overseas Bank, 10-3-761/7/2, Vijayanagar Branch, Hyderabad-500 057.
.. Respondent The Court made the following:
ORDER:
The purport of the interim order granted by this Court in W.P.M.P.No.27863 of 2014 in W.P.No.22212 of 2014 was not to insist for consent-cum-no objection letters in the absence of any restraining order or to insist probate of will to release the amounts bequeathed to the beneficiaries under the said will.
2. As per the letter communicated to the learned Standing Counsel, all the amounts in respect of deposits and Savings Bank accounts of Late Smt. B. Sarojini Pulla Reddy as per the Will were released to various beneficiaries and the details of the amounts released were enclosed. The letter says that where there are nominees and are alive, the amounts are not released. By such stand, it cannot be said that the authorities of the respondent bank have violated the orders of the Court. Hence, I see no justification to initiate proceedings under the Contempt of Courts Act, 1971.
3. The Contempt Case is, accordingly, closed. The closure of the contempt case does not take away the right of the petitioners to claim other amounts also, if they are entitled to, in
accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
