THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI SECOND APPEAL No.1258 of 2013 JUDGMENT:- This Second Appeal, under Section 100 C.P.C., is filed by the appellant assailing the decree and judgment dated 04.01.2013 of the learned Senior Civil Judge, Razole, passed in A.S.No.16 of 2010, whereby, the learned Senior Civil Judge, while allowing the said appeal, had set aside the decree and judgment dated 28.10.2010 of the learned Junior Civil Judge, Razole, passed in O.S.No.33 of 2004.

2. When the matter was taken up for hearing, learned counsel for the appellant submits that a letter dated 11.06.2015 was filed before the Registry of this Court stating that the counsel was instructed to withdraw the second appeal and accordingly, seeks permission of this Court to withdraw the appeal.

3. In view of the submissions in the letter, dated 11.06.2015, and the submissions now made by the learned counsel, permission is accorded to withdraw the second appeal.

4. Accordingly, the second appeal is dismissed as withdrawn. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this appeal shall stand dismissed.
