HON'BLE SRI JUSTICE S.V. BHATT W.P.No.17525 OF 2015 ORDER:

The petitioner filed W.P.No.39939 of 2012 praying for disposing of his representation or restoring agricultural land an extent ofAc.4-45 cents in Sy.No.300-2A of Chennampalli Village, B.K.Samudram Mandal, Anantapur District.

The writ petition was disposed of by order dated 17.02.2014. The order reads thus:

"As stated by the learned Government Pleader, since the petitioner's application for assignment is pending consideration by the respondent authorities, interest of justice would be served by directing respondent Nos.1 to 3 to consider petitioner's request for assignment, dated 10.02.2012 and for which the Collector, Anantpur had already called for report from the Revenue Divisional Officer, Anantapur, under his proceedings in L.Dis.No.2384/2912/E4 dated 14.03.2012, Ex.P2 annexed at Page No.15. Let the action be, accordingly, taken up by respondent Nos.1 to 3, as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order".

The petitioner filed the present writ petition slightly changing the nature of prayer, however, he is attempting to get the relief for which he was unsuccessful in W.P.No.39938 of 2012. Be that as it may, the circumstances are not in dispute and the 4th respondent in the counter affidavit dated 12.02.2016 had stated thus: ".....Hence, no Government land is available in Bukkarayasamudram Mandal for grant of assignment in favour of the petitioner Sri L.Sankar Reddy, s/o late Aswartha Reddy. But, the petitioner has stated that, the 3rd respondent is not passing orders for allotment of land in Sy.No.300-2A extent 4.45 acres of Chennampalli Village of

Bukkarayasamudram Mandal in his favour. The Hon'ble High Court has ordered that, no legal right to the petitioner exist on the land in Sy.No.300-2A extent 4.45 Acres of Chennampalli Village of Bukkarayasamudram Mandal. Even though, the District Collector, Ananthapuramu has been requested to issue necessary orders with regard to assignment of land in Sy.No.300-2A extent 4.45 Acres of Chennampalli village of Bukkarayasamudram Mandal in favour of the petitioner, as no Government Agricultural land is available for grant of assignment and he is eligible for grant of assignment. Orders of the District Collector, Ananthapuramu are awaited in the matter".

Having regard to the above statement, Mr.K.Srinivas requests the Court to permit the petitioner to approach the District Collector on the pending representation or letter forwarded by the 4th respondent. Permission is granted.

Writ petition is disposed of accordingly. There shall be no order as costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
