THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19444 OF 2015 ORDER :

It is stated by the learned counsel for the petitioners that in similar circumstances, this Court disposed of W.P.No.29220 of 2012 on 07.06.2016 and same is not disputed by the learned Assistant Government Pleader for Revenue. In view of the submission of the learned counsel for the petitioners, this writ petition is allowed and the order passed by the 3rd respondent on 12.09.2012 is set aside.

The petitioners shall appear before the 3rd respondent on 22.07.2016 at 11.00 a.m in his office on which date the respondents 3 and 4 shall service show cause notices on each of the petitioners; the petitioners are granted three weeks' time from that date to reply to the show cause notices; and thereafter the 3rd respondent shall pass a reasoned order after considering the explanations of the petitioners in accordance with law. If the petitioners do not appear before the 4th respondent on that day or do not file explanations to the show cause notices issued by the 3rd respondent, it is open for the 3rd respondent to decide ex parte. This exercise shall be completed by the 3rd respondent on or before 30.12.2016. Till then, the petitioners shall not be evicted from the house sites in their occupation. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed.
