Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
The petitioner is a fair price shop dealer of shop No.76 of Subbaraopeta, Dharmavaram Town, Anantapur District. A showcause notice was issued to the petitioner on 23-02-2015 alleging certain irregularities. The petitioner submitted her explanation on 0203-2015 and after considering the same, the impugned order was passed on 23-03-2015 suspending the authorization of the petitioner pending enquiry. Challenging the same, the present writ petition is filed.
Learned counsel for the petitioner submitted that the allegations in the impugned order are frivolous and infact, the card holders submitted a representation on 02-03-2015 to the third respondent and in view of the same, the impugned order should be set aside. But this Court is not inclined to do the same in view of the proceedings pending before the third respondent. However, the third respondent is directed to conclude the enquiry after giving due opportunity to the petitioner and after considering the representation of the card holders dated 02-03-2015 and pass final orders thereon, within a period of (30) days from the date of receipt of the copy of the order. Accordingly, the writ petition is disposed of. In consequence, the miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
