THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.387 OF 2016 ORDER:

This revision is filed by the petitioner challenging the order dated 7.1.2014 passed in M.C.No.2 of 2014 on the file of Tahsildar & Mandal Executive Magistrate, Sirivel, Kurnool District. Heard and perused the material available on record. The Sub-Inspector of Police, Sirivel, requested the Tahsildar & Mandal Executive Magistrate concerned, to promulgate orders under Section 145 Cr.P.C. in the boundaries of Sy.Nos.482/B, 626 and 627 o f Boilakunta Village, Sirivel Mandal, on the ground that the civil disputes are causing law and order problem in the village, which is a faction village under Category-III. On such request, the learned Mandal Executive Magistrate passed the order impugned herein. The order impugned was passed on 7.1.2014 and the present revision is filed after lapse of two years.

Admittedly, no agricultural produce was raised in the lands in question because of the order impugned herein. From the order under revision, it is manifest that the authorities concerned decided to adjudicate the issue after conducting an enquiry. Therefore, it is just and proper to direct the authorities concerned to complete the enquiry and pass appropriate orders in accordance with law.

In the circumstances, the Tahsildar & Mandal Executive Magistrate, Sirivel/Authority concerned is directed to complete the enquiry and pass appropriate orders in accordance with law, within a period of three months from the date of receipt of a copy of this Order. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand

closed.
