ORDER:

Feeling aggrieved by the non-consideration of her representation by the respondents for appointment as temporary dealer of fair price shop No.26 of Chellur Village, Rayavaram Mandal, East Godavari District, the petitioner filed this writ petition.

It is not in dispute that the authorization of the permanent fair price shop dealer of shop No.26 was suspended on the ground that a criminal case is pending against him. The learned Assistant Government Pleader for Civil Supplies (AP) submitted that as the criminal case is still pending and the permanent fair price shop dealer is still continuing under suspension, incharge arrangement is made by entrusting distribution of essential commodities to the neighbouring dealer. In my opinion, it is not desirable to continue the incharge arrangement for a long period. Instead, it would be appropriate if respondent No.2 appoints a temporary dealer by inviting applications from the eligible persons, by duly publicizing the same in the village and by making it clear that the appointment of the

selected candidate will be purely temporary and the same will not confer any right on such candidate for permanent appointment. Respondent No.2 shall initiate this process and complete the same within a period of two months from the date of receipt of a copy of this order. The petitioner is also entitled to apply for temporary dealership along with others.

Subject to the above directions, the Writ Petition is disposed of. As a sequel to the disposal of the writ petition, W.P.M.P.No.30551 of 2011 filed by the petitioner for interim relief shall stand disposed of as infructuous. __________________________ C.V.NAGARJUNA REDDY, J 07th October, 2015 GHN
