Heard learned counsel for the petitioner and learned Assistant Government pleader for Services-1 for learned Government pleader for Education.

Petitioner was placed under suspension by order dated 22.03.2018. Thereafter, charge memo was issued, disciplinary action was initiated leading to conducting of enquiry and submission of report by the Enquiry Officer. Thereafter on 18.07.2018 a show cause notice was issued enclosing the findings of the Enquiry Officer. The Enquiry Officer held the charge against the petitioner as proved. Petitioner claimed to have submitted his explanation on 04.08.2018. At this stage, this writ petition is filed. 3.

When the matter is taken up for consideration learned counsel for the petitioner submits that he is confining the relief in the writ petition only to the order of suspension. 4.

It is not in dispute that the order of suspension is passed by the competent authority. A reading of the order itself would show that based on the material placed before the competent authority, suspension was made. Thus, the order of suspension cannot be held as illegal warranting interference by this Court. 5.

At this stage, learned counsel for the petitioner submits that as petitioner has already filed explanation, if some time is fixed for completing the exercise would suffice his interest.

Having regard to the above submissions, the Writ Petition is disposed of directing the Commissioner, Printing, Stationery and Store Purchase Department-2nd respondent to pass orders on due consideration of the explanation submitted by the petitioner to the show cause notice dated 18.07.2018, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of copy of this order. It is made clear that this Court has not gone into the allegations leveled against the petitioner. It is also open for the petitioner to avail appropriate remedies as available in law, after the orders are passed by the disciplinary authority on due consideration of the explanation. Pending miscellaneous petitions, if any, shall stand closed.
