HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11926 OF 2017 ORDER:

This writ petition is filed against the proceedings in RCB/662/16, dated 20-02-2017, whereby the petitioner's borewell was directed to be seized.

Learned counsel for the petitioner submits that though the petitioner filed explanation to the notice dated 17-12-2016, but the same was not considered. Learned counsel appearing for the 5th respondent submits that as the petitioner dug borewell in the prohibited distance after conducting enquiry, impugned order is passed. The petitioner has alternative remedy against the impugned order. Heard learned Assistant Government Pleader for Revenue.

The impugned order is set aside on the ground of violation of principles of natural justice. However, it is open for the petitioner to file one more copy of the explanation to the 4th respondent within a period of two weeks from today. On submission of copy of explanation, after giving opportunity of hearing to the petitioner as well as the 5th respondent, the 4th respondent is directed to pass orders afresh within a period of two weeks after the petitioner files explanation.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 06-04-2017 Note:
