THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26259 of 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition & Excise(A.P.). When the matter is taken up, a letter bearing Rc.No.191/2017/B, dated 21.08.2017, addressed by the Prohibition & Excise Superintendent, Anantapuramu to the learned Government Pleader for Prohibition & Excise (A.P.), has been placed on record by the learned Government Pleader. The relevant portion of the said letter reads as under:
"In this connection, notice was issued to the successful applicant (K.Karunakar Rerddy, S/o Krishna Reddy) as per judgment of the Hon'ble Supreme Court orders for the sale of liquor along National and State Highways and over a distance of 500 meters from the outer edge of the highway or a service lane alongside. In view of the above, informed to the successful applicant to select some other suitable premises within Ananthapuramu Municipal Corporation for establishment of A4 shop (GSL.No.AT/23) as you are not restricted to any particular division or locality in the municipal corporation.
Further it is submitted that the successful applicant(K.Karunakar Reddy, S/o Krishna Reddy) writ petitioner has selected another suitable premises, at D.No.6-3-377, Ram nagar, Ananthapuramu, for establishment of A4 shop and the licence has been issued to the above successful applicant on 04.08.2017, and the business
transactions are going on at the above licensed premises".
In view of the subsequent developments, nothing survives for adjudication in the Writ Petition.
The Writ Petition is, accordingly, disposed of, by placing on record the above instructions.
As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
