HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5739 of 2011 ORDER:

This Criminal Petition is filed by the petitioner-accused No.3, under Section 482 Cr.P.C., seeking to quash the proceedings in C.C.No.66 of 2011 on the file of the XII Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad, taken on file for the offences under Sections 120-B, 406 and 420 IPC.

Heard both sides.

After arguing for some time, learned counsel for the petitioner has not insisted for the main prayer and prayed for dispensation of the presence of the petitioner before the trial Court. Considering the submission of the learned counsel for the petitioner and the nature of allegations wherein the question of identity of the petitioner before the trial Court does not arise, his appearance before the trial Court is dispensed with except the dates on which the learned Magistrate insists for his appearance and he is permitted to be represented through his counsel.

Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, filed shall stand closed.
