THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28275 of 2015 ORDER:
The petitioner was appointed as a Fair Price Shop dealer of Shop No.2, Kothacheruvu Village Mandal, Anantapuram District on compassionate ground. While so, a show cause notice was issued on 03.08.2015 framing three charges against the petitioner and the petitioner submitted his explanation on 14.08.2015. It is the case of the petitioner that without properly considering his explanation, a suspension order was issued on 25.08.2015. Challenging the same, the present writ petition is filed.
In view of the nature of charges, this Court is not inclined to interfere with the enquiry process at this stage. Though the learned counsel for the petitioner tried to impress upon the Court that the charges do not warrant suspension, and particularly pointing out that the charge No.1 does not exist as the Stock Register of July 2015 showed only five litres as available balance, and in those circumstances, it cannot be held that the petitioner sold 220 litres of kerosene to one Khaleem Sab for selling it in black market, the said fact has to be verified during enquiry only.
In view of the explanation submitted by the petitioner, the second respondent is directed to complete the enquiry by giving due opportunity to the petitioner within sixty (60) days from the date of receipt of a copy of this order.
This Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
