HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.449 of 2016 ORDER:
This petition is filed to withdraw divorce O.P.No.30 of 2016 from the file of Senior Civil Judge, Rajampet, and transfer the same to Family Court, Kurnool.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 27.02.2015 at Badvel town, Kadapa District, as per Hindu rites and custom. She stated that she worked as Assistant Doctor under one Dr.Praveen Kumar Reddy, who created all the troubles for her marital life. She stated that she is now staying at Kurnool and respondent filed divorce O.P. at Rajampet, where she is facing threat, for which she lodged a complaint. She further stated that it is difficult for her to travel from Kurnool to Rajampet.
For these reasons, she prayed for transfer of divorce O.P. from Rajampet to Kurnool

Respondent filed counter disputing the affidavit averments of petitioner and mainly contended that he has got a life threat at Kurnool in the hands of very same Dr.Praveen Kumar Reddy and that there are no other proceedings pending at Kurnool. He stated that there are no grounds to transfer and petitioner does not suffer any injury if case is not transferred to Kurnool.
4. Heard both sides.
5. Both sides submitted their arguments supporting respective contentions of their clients.
6. From the submissions and the affidavits of both parties, it is clear that respondent is having life threat at Kurnool and even according to petitioner she also got threat from very same person Dr.Praveen Kumar Reddy at Kurnool.
7. Considering the submissions of both sides, it is clear that divorce O.P. has to be transferred to any Court other than Kurnool.
Both sides are enquired about convenient places and both advocates agreed for transfer of case to Atmakur, where a Senior Civil Judge's Court is located.
8. For these reasons, divorce O.P.No.30 of 2016 is withdrawn from Senior Civil Judge, Rajampet, and transferred to Senior Civil Judge, Atmakur, Kurnool District, for disposal in accordance with law.
9. Transfer C.M.P. is ordered accordingly.
10. Miscellaneous petitions pending, if any, shall stand closed.
