HON'BLE SRI JUSTICE S.V.BHATT W.P. No.15693 OF 2007 ORDER:

The petitioner complains against the threatened action of respondents in entering petitioner's land in Survey Nos.301/C and 301/2 of extent of Ac.2.71 cents of Vannechintalapudi Village, Amalapuram Mandal, East Godavari District without following the procedure prescribed by law, as illegal, arbitrary and unconstitutional. On 24.07.2007, this Court granted stay of dispossession of petitioner from subject matter of the writ petition. The Assistant Government Pleader places on record the communication No.B/1506/2006 dated 28.08.2016 and states that the subject land is not acquired by respondents. The operative portion reads thus: "The Tahsildar, Amalapuram has submitted a report in the reference 2nd cited that the land measuring Ac.2.81 cents in R.S.No.301/IC of Vennechintalapudi village of Amalapuram Mandal is not required for providing house sites.

I, therefore, submit that the proposed land measuring Ac.2.81 cents in R.S.No.301/IC of Vannechintalapudi village of Amalapuram Mandal is not required for providing house sites under Indiramma scheme at present. This is submitted for favour of information. I enclose herewith a copy of the report submitted by the Tahsildar, Amalapuram in the reference 2nd cited for kind perusal ." The statement of respondents is placed on record and the writ petition is ordered accordingly. No order as to costs.
