HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.4063 OF 2010 ORDER:
The proceedings, under challenge in this Writ Petition, is a notice dated 05.02.2010 directing the petitioner to stop using blasting material for conducting quarrying operations and to use hand drills only, otherwise action would be initiated against him. While an interim order was passed directing the petitioner not to carry on drilling operations within 200 metres of the nearby habitation, the fact remains that the impugned notice merely calls upon the petitioner to stop using blasting material informing him that action would be taken, if he failed to do so. I consider it appropriate, in such circumstances, to permit the petitioner to submit his reply to the aforesaid notice within two weeks from today; and on such a reply being filed, it is open to the respondents to pass orders thereupon, and take action in accordance with law.
Needless to state that, in case the petitioner fails to submit his reply to the notice within two weeks, it is open to the respondents to proceed and take action against him without granting him any further time. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
