CVNR, J CRP.Nos.4671 & 4682 of 2018 Dt: 20.09.2018 Common Order:

These two Civil Revision Petitions (CRPs) arise out of Common Order, dated 25-07-2018, in IA.Nos.860 and 861 of 2018 in OS.No.323 of 2007 on the file of the VI Additional Senior Civil Judge, Visakhapatnam. I have extensively heard the learned Counsel for both parties. The crux of the issue in these CRPs is, whether the petitioner/defendant No.1 is entitled to cross-examine PW.1 on the entries in Ex.A.7, which was, admittedly, introduced by the respondent/plaintiff after he was cross-examined by the Counsel for the petitioner. In my opinion, propriety and fairness require that the petitioner is given an opportunity to cross-examine the respondent on the entries in Ex.A.7.

In this view of the matter, the orders under revision are set aside. Considering the fact that the suit is of the year 2007, the Court below shall fix a specific date, not later than one month from the date of receipt of this order, for further cross-examination of the respondent by the Counsel for the petitioner to the limited extent of entries in Ex.A.7 only. Subject to the above observations and directions, these CRPs are allowed to the extent indicated above.

As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
