HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.13643 of 2009 ORDER:

This writ petition is filed to declare the action of the respondents in interfering with peaceful possession and enjoyment of the property admeasuring Ac.8.78 cents in R.S.No.118 situated at Balemala village, Musunuru Mandal, Krishna District, as illegal and arbitrary.

The case of the petitioner is that, the 5th respondent has given the subject land on lease; the writ petitioner is one of the lessee to the subject extent pursuant to the auction held on 9.9.2005 for a period of three years; after the lease period expired, the 5th respondent renewed the lease for a further period of three years commencing from 10.9.2008 to 9.9.2011; one new Executive Officer was posted to the said temple during the middle of June, 2009 and that he is asking the petitioner not to carry out any agricultural operations in the subject land. Heard the learned counsel for the petitioner and the learned Standing Counsel for the 5th respondent.

Admittedly, the lease period expired on 9.9.2011. Both counsel states that as the lease period has expired, no further orders are necessary in the writ petition.

Accordingly, the Writ Petition is closed. No order as to costs.
