This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.1462 of 2022 pending on the file of Station House Officer, L.B.Nagar Police Station, Rachakonda registered for the offences punishable under Sections 376, 342, 366, 493 and 506 of Indian Penal Code (IPC) and Section 3 read with Section 4 of POCSO Act. 2.
Heard learned counsel for the petitioner/Accused and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he was acquainted with the victim girl who is aged about 17 years, due to their acquaintance it is alleged in the remand report that the victim girl accompanied this petitioner on 03.09.2022 and from there they went to Charminar. They spent time till evening in the Charminar area and during midnight they went to the house of this petitioner at Meerpet. Having made promise that the petitioner would marry the victim girl, she was exploited sexually without consent.

On perusal of the remand report, it is apparent that the petitioner and the victim girl were known to each other since several years. However, the victim girl had accompanied the petitioner to his residence, where they spent one night together and according to the de facto complainant, the petitioner made the victim girl believe that he was in love with her and would marry her. 5.
In the said circumstances, since the petitioner is in jail from 05.09.2022 and the major part of the investigation is complete, the prayer for regular bail can be considered.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:
i) The petitioner/Accused is directed to be released on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of II Additional Metropolitan Magistrate, Cyberabad at L.B.Nagar.
ii) After release on bail, the petitioner/Accused shall appear before the concerned Station House Officer on every Monday
between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
