THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CIVIL MISCELLANEOUS PETITION No.858 of 2016 ORDER:

This transfer petition is filed under Section 24 of CPC, seeking to withdraw F.C.O.P. No.1402 of 2016 from the file of the Additional Family Court, City Civil Court, Hyderabad and transfer the same to the file of the Principal Senior Civil Judge Court, Machilipatnam. 2.

Heard learned counsel for both the parties.

At the time of hearing, learned counsel for the respondent, in all fairness, submitted that the respondent is ready to pay an amount of Rs.5,000/- (Rupees five thousand) to the petitioner as and when she appeared in F.C.O.P. No.1402 of 2016 on the file of the Additional Family Court, City Civil Court, Hyderabad. Learned counsel for the petitioner fairly agreed for the same. In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case.

Accordingly, the Transfer C.M.P., is disposed of, with a direction that the respondent has to pay an amount of Rs.5,000/- (Rupees five thousand) to the petitioner, in open Court, as and when she appeared in F.C.O.P. No.1402 of 2016 on the file of the Additional Family Court, City Civil Court, Hyderabad. On receipt of the payment, the petitioner shall issue receipt in favour of the respondent. This order will be in force till disposal of F.C.O.P. No.1402 of 2016.
