THE HON'BLE Dr. JUSTICE G. RADHA RANI CRIMINAL PETITION No.13436 OF 2024 ORDER:

This criminal petition is filed by the petitioner - accused No.1 under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of regular bail in Crime No.1034 of 2024 of PS Hayathnagar, Ranga Reddy District registered for the offence under Section 109 read with 3 (5) of Bharatiya Nyaya Sanhitha, 2023.

Heard Sri P.Manoj, learned counsel appearing for the petitioner and the learned Additional Public Prosecutor for respondent - State.

Learned counsel for the petitioner submitted that there were no specific allegations leveled against the petitioner. The petitioner was falsely implicated in the above crime. The petitioner belonged to a good family with no criminal antecedents, he was arrested on 08.09.2024 and since then he was in custody and prayed to enlarge the petitioner on bail. 4.

Learned Additional Public Prosecutor opposed grant of bail to the petitioner stating that the petitioner stabbed the injured

on his back with an intention to commit his murder, and as such he was not entitled for grant of bail.

As per the contents of the complaint, it was stated that three unknown persons came on a scooty to Raghavendra Hotel near Saibaba Temple, Hayathnagar in drunken condition and picked up quarrel with the brother of the complainant while his brother along with his friends went to the said hotel for having tiffin and one of the three unknown persons attempted to kill his brother with a button knife and caused bleeding injury to him on his back. The said complaint would not disclose any previous enmity between the injured as well as the present petitioner herein to have any motive or intention to kill. The weapon stated to be used is only a button knife (nail cutter knife) and that too on the back but not on any vital organ of the body. As it was reported that the injured was treated as outpatient and was sent on the same day after treatment and considering that the petitioner was in custody for the past 61 days since 08.09.2024, it is considered fit to enlarge the petitioner on bail.

In the result, this Criminal Petition is allowed, directing the petitioner - accused No.1 to be released on bail, subject to the following conditions:

i) The petitioner - accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties each for a like sum to the satisfaction of the XIV Additional Metropolitan Magistrate, at Hayathnagar.

ii) The petitioner - accused No.1 shall abide by the conditions stipulated in Section 480 (3) of Bharatiya Nagarik Suraksha Sanhitha, 2023.

Miscellaneous applications, if any, pending, shall stand closed.
