Heard.
The petitioner claims to own an extent of Ac.0.36 1⁄2 cents in Survey No.409 of Martur Village, Prakasam District. Alleging that the 3rd respondent is physically interfering into the said land, the present writ petition is filed.
Learned Government Pleader for Revenue received instructions from the 3rd respondent, which state that out of the land admeasuring Ac.0.65 cents claimed by the petitioner and others, the petitioner is stated to have already sold Ac.0.63 cents to Kukkapalli Gopala Krishna and three others vide document Nos.167 of 2009 etc. and she is only left with Ac.0.02 cents of land. Accordingly, appropriate entry is stated to have been made in the Web land. However, regarding allegation of interference, the instructions do not speak of. In view of that, the writ petition is disposed of directing the 3rd respondent that if he intends to take any action against the petitioner, he shall follow due procedure prescribed under law viz., giving of notice and calling for explanation and thereafter only take further action.
So far as the claim of the petitioner for the extent claimed in the writ petition is concerned, it is open for her to take appropriate steps, if the said extent is reduced by the 3rd respondent. There shall be no order as to costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
