HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11391 of 2017 ORDER:

This writ petition is filed seeking to declare the action of the respondents in seizing the Motor Cycle bearing No.AP 02BB 7602 belonging to the petitioner, as illegal and arbitrary.

The case of the petitioner is that his Motor Cycle bearing No.AP 02BB 7602 was seized on 24.01.2017, on the ground of violation of the provisions of the Essential Commodities Act, 1955 (for short, 'the Act') and he made a representation for release of the said vehicle. As no orders are passed yet on the said representation, the present writ petition is filed.

Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

No useful purpose will be served in keeping the vehicle idle pending enquiry under Section 6-A of the Act and the same will get spoiled.

In view of the same, the respondents are directed to release the Motor Cycle bearing No.AP 02BB 7602 to the petitioner, pending enquiry under Section 6-A of the Act, on furnishing security to their satisfaction within a period of two weeks from today.
