THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39322 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the impugned proceedings in Rc.No.613/RFO/ER/2015 of the fourth respondent as illegal and arbitrary, and consequently, to set aside the same. Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner applied for 'No Objection Certificate for Occupancy' of the petitioner hospital and that the fourth respondent by way of proceedings referred above, dated, 18.06.2016, requested the petitioner to obtain permission from the Hon'ble High Court for considering the 'No Objection Certificate for Occupancy' and as such, the petitioner approaches this Court by way of the present writ petition.
Considering the facts and circumstances of the case, the fourth respondent is directed to issue 'No Objection Certificate for Occupancy' of the petitioner hospital, without insisting for any 'Provisional No Objection Certificate' if the petitioner complies with all the requirements for issuance of 'No Objection Certificate',.
