HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Writ Appeal No.1078 of 2018 JUDGMENT: (per Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) This writ appeal is against the order of the learned Single Judge, refusing to issue a direction requiring the 1st respondent-Andhra University to permit the petitioner for admission to M. Phil, Ph. D, in the subject areas offered.

2. Admittedly, the Andhra University could not permit the appellant to be admitted to the part-time M. Phil., Ph.D., in accordance with the existing provisions of the prospectus. The appellant does not fall within the zone of consideration in terms of the existing prospectus. What the appellant actually wants is a declaration that the eligible qualification should be at par with those prescribed by the other Universities. The learned Single Judge has thought it fit to determine that issue in the writ petition rather than granting any interlocutory order.

3. After hearing the learned counsel on both sides, we do not find any illegality or infirmity with the impugned order. We see no grounds to interfere with the order of the learned Single Judge. Hence, the writ appeal fails and the same is, accordingly, dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
