THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.17766 OF 2010 ORDER:

The present writ petition is filed seeking issuance of writ of mandamus by declaring the action of the 3rd respondent in excluding the petitioner-institution for allotment of students to 1st year General Nursing and Midwifery Course for the academic year 2010-2011 despite including the name of the petitionerinstitution in the list of eligible institutions by the 2nd respondent in Rc.No.23616/NEA/2010, dated 29.06.2010 as arbitrary, illegal and contrary to legitimate expectation and consequentially direct the respondents to allot students for the 1st year G.N. & M Course for the academic year 2010-2011.

2. As Sri K.G.K. Prasad, learned counsel for the petitioner is no more, this Court issued notice to the petitioner-institution. But, the same was returned unserved.

3. Learned Government Pleader for Medical and Health submits that no cause survives for adjudication in the writ petition since the grievance was with regard to allotment of students for the year 2010-2011.

4. By an Order, dated 28.07.2010, this Court while issuing rule nisi granted interim direction. Since the main relief in the writ petition is for admission of the students of the year 2010-2011, nothing survives for adjudication at this point of time.

5. Hence, the writ petition is closed. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
