ORDER:
The petitioner is the proprietor of Sree Lakshmi Venkateswara Modern Rice Mill, who has been doing the business of rice with a license issued by the respondents. While so, the mill was inspected on 05.09.2014 and seized the quantity worth Rs.49,92,690/-. A show cause notice was issued to the petitioner on 06.09.2014 and the petitioner submitted his explanation. While so, an order was passed by the second respondent on 01.03.2015 for interim disposal of the stock, pending finalization of 6A proceedings on the petitioner furnishing personal security bond to the extent of the value of the stock seized. The said order was modified on 18.06.2015 by directing the petitioner to produce bank guarantee for Rs.50.00 lakhs. Though the petitioner could furnish the personal security bond pursuant to the order dated 01.03.2015, he expressed his inability to follow the order dated 18.06.2015. In view of the pendency of the proceedings since September 2014, the petitioner filed the present writ petition. It is an admitted case that 6A proceedings are pending before the second
respondent in respect of the stock seized on 05.09.2014. In the circumstances, this Court deems it fit to direct the second respondent to dispose of 6A case pending before him within sixty (60) days from the date of receipt of a copy of this order. Till disposal of the said case, the seized stock shall not be sold.
With the above directions, the Writ Petition is disposed of Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
