THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37674 of 2015 ORDER:
The grievance of the petitioner was that the Station House Officer, Krishnalanka Police Station, Vijayawada City, Krishna District, was interfering with his property rights in relation to a vacant site situated at Door No.39-9-26, Labbipet, Vijayawada Town, Krishna District, at the instance of the 3rd respondent. Written instructions dated 27.11.2015 were furnished by the Sub-Inspector of Police, Krishnalanka Police Station, Krishna District, to the office of the learned Government Pleader for Home, wherein he stated that Crime No.554 of 2008 had been registered under Sections 427 and 447 I.P.C. upon the complaint made by the Assistant Engineer, Irrigation Department, Vijayawada. This crime was registered on the file of Krishnalanka Police Station and the petitioner was shown as the accused therein.
Upon due investigation, a charge sheet was stated to have been laid against the petitioner vide C.C.No.421 of 2012 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada. The petitioner was stated to have obtained stay of all further proceedings in this case by order dated 15.07.2015 granted by this Court in Criminal Petition No.3753 of 2015. Insofar as the subject complaint of the petitioner is concerned, the Sub-Inspector of Police categorically stated that the police authorities never interfered with the petitioner's property and therefore, the allegations made to that effect were denied. In the light of the aforestated stand of the police authorities, which is duly taken on record, no adjudication is warranted on merits. The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
