THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1154 OF 2014 ORDER:

This Criminal Revision Case is filed by the accused officer challenging the orders of the Judge, Special Court for Trial of ACB Cases in Rayalaseema Region at Kurnool dated 28.4.2014 in Crl.M.P.No.230 of 2013 in C.C.No.69 of 2013 whereby the learned trial judge ordered for return of six items of gold jewellery weighing 210.8 grams pending disposal of the C.C. on condition of petitioner furnishing bank guarantee for Rs.7.00 lakhs as against the surety offered by the petitioner for Rs.1.50 lakhs. The facts of the case are as follows:

The petitioner-Accused Officer was working as Special Collector, Land Acquisition, Srisailam Project and he is facing trial in C.C.No.69 of 2013 for owning assets disproportionate to his known sources of income. Pending the trial, he filed the impugned application seeking return of six items of gold jewels weighing 210.80 grams seized by the officials of respondent from Locker No.A-17 of IDBI Bank, Kukatpally Branch by accepting the security for Rs.1.50 lakhs by cancelling the attachment orders dated 26.8.2011. However, the trial Court ordered for return of the jewel articles on condition of petitioner furnishing bank guarantee for Rs.7.00 lakhs as against the surety offered by him for Rs.1.50 lakhs. Aggrieved by the bank guarantee for Rs.7.00 lakhs, the present revision is filed.

The trial Court keeping in mind the worth of the jewel items and also the time lag that may take for disposal of the C.C. rightly directed the petitioner to furnish the bank guarantee for Rs.7.00 lakhs. The said order does not suffer from any infirmities warranting interference by this Court.

The revision fails and the same is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
