Heard learned counsel for the petitioner and learned Government Pleader for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.25, K.Uppalapadu Village, Kondepi Mandal, Prakasam District. While so, the fourth respondent passed an order on 14.08.2015 appointing an in-charge fair price shop dealer for shop No.25. Challenging the same, the present Writ Petition is filed.

3. This writ petition came up for consideration on 21.08.2015 and it was adjourned for instructions of the learned Government Pleader. Now the learned Government Pleader states that though a show cause notice was issued, the authorization of the petitioner was not suspended. 4.

In the circumstances, the fourth respondent ought not to have passed the order dated 14.08.2015 appointing the in-charge dealer when the authorization of the petitioner is in force. 5.

Therefore, the impugned order dated 14.08.2015 passed by the fourth respondent is set aside and the writ petition is allowed. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
