THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.28434 of 2018 ORDER:

In this Writ Petition, petitioner challenges notice, dated 03.08.2018 issued by the second respondent - Bhainsa Municipality, rep. by its Commissioner, Bhainsa, Adilabad District, mainly on the ground that the second respondent had not setout the details of the deviations alleged to have been made by her.

A reading of the impugned notice discloses that the petitioner continues to make constructions contrary to the assertion made by her in an earlier Writ Petition that her BRS application is pending.

It may be noted that BRS application would be with respect to the constructions which are made already but not with respect to the ongoing constructions.

In those circumstances, the Writ Petition is disposed of with the direction to the respondents not to cause any demolition with respect to the property in question. It is made clear that the respondents shall ensure that photographs of the construction of the subject property as on today are taken and shall monitor the

CKR, J W.P.No.28434 of 2018 same to ensure that the writ petitioner does not make any further construction under the guise of the orders of this Court. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
