Adapa Devi v. State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.12398 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. seeking early disposal of C.C.No.425 of 2014 on the file of the Addl. Judicial Magistrate of First Class, Addanki. Heard both sides.
The main grievance of the petitioner/de-facto complainant in C.C.No.425 of 2014 is that even though the respondents 2 and 3/A-1 and A-2 made their appearance long back in the month of November, 2014, the learned Magistrate is not proceeding with framing of charges/ examination of accused and is adjourning the matter routinely once in two (2) months and even though the matter is pending for two years no progress is made. Learned counsel for the petitioner has produced material before this Court evidencing that the case is adjourned for once in two months without examining the accused persons even though they are appearing before the Court below.
In view of the above, the Criminal Petition is disposed of, directing the learned Magistrate to dispose of C.C.No.425 of 2014 within a period of six (6) months from the date of receipt of a copy of this order without fail.
Pending miscellaneous applications, if any, shall stand closed in consequence.
